These Terms of Service (“Terms”) govern your access to and use of the websites and software services operated by 24-7 Press AI Solutions, LLC (“24-7 Press,” “we,” “us,” or “our”), including 24-7Press.com and related products such as TextBackAI (collectively, the “Service”).
By creating an account, clicking “I agree,” or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you are entering into these Terms on behalf of a business, you represent that you have authority to bind that entity.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract. You may not use the Service if you are barred under applicable law or carrier policy.
2. Accounts & Security
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately at support@24-7press.com of any unauthorized use. We may suspend or terminate accounts for security reasons.
3. Description of Service
TextBackAI provides cloud-based missed-call detection and automated text messaging through third-party telecommunications networks (primarily Twilio).
Messages are delivered from a TextBackAI-assigned phone number that connects to your business line; they do not appear on your personal device.
We may update or change features from time to time. New features are subject to these Terms.
4. Free Trial and Paid Plans
- Free Trial: New users receive 10 free text credits. A valid credit card is required to verify your business, but you will not be charged until you select a plan.
- Plans & Credits: Starter (100 credits/mo $29), Pro (500 credits/mo $79), Elite (1,500 credits/mo $149). Unused credits expire at the end of each billing cycle.
- Billing: Subscriptions renew automatically each month through Stripe until canceled. You authorize us to charge your card for renewals and usage beyond plan limits.
- Cancellations: You may cancel anytime via your dashboard. Access continues until the end of the current billing period; we do not prorate refunds.
- Price Changes: We may modify plan pricing with reasonable advance notice via email or the dashboard.
5. Acceptable Use & Messaging Rules
You agree to use the Service only for lawful business communications and to comply with:
- All U.S. laws (including TCPA and CAN-SPAM)
- Twilio’s and carrier A2P 10DLC requirements
- Our SMS Terms and Messaging Policy
You will not use the Service to send or facilitate any of the following:
- Unsolicited marketing or spam texts
- SHAFT content (sex, hate, alcohol to minors, firearms, tobacco/vapes)
- Illegal, fraudulent, or deceptive messages
- Content that infringes intellectual property or privacy rights
Each automated message must include: “Reply STOP to opt out, HELP for help.” If a recipient replies STOP, you must honor the opt-out; our system enforces this automatically.
We may review and suspend messaging activity that violates these rules or carrier policies.
6. Data & Privacy
Our use of personal information is governed by our Privacy Policy. By using the Service, you authorize us and our processors (e.g., Stripe, Twilio, Supabase, Postmark, Mailchimp, Lovable) to store and process data as needed to provide the Service.
You retain ownership of the content you submit (messages, contacts, templates). You grant us a limited license to process and transmit that content solely to operate the Service.
7. Service Availability & Support
We strive for high uptime but do not guarantee uninterrupted access. Telecom networks, carriers, and third-party APIs may occasionally fail or delay delivery. We provide reasonable email support during business hours and priority support for Pro and Elite plans.
8. Intellectual Property
All software, text, graphics, logos, and other materials in the Service are owned by 24-7 Press or its licensors and protected by copyright and trademark law. You may use the Service only as expressly permitted in these Terms. No rights are granted by implication.
9. Prohibited Conduct
You may not:
- Reverse engineer or attempt to extract source code from the Service.
- Use the Service for competitive analysis or resale without written permission.
- Overburden our infrastructure or interfere with others’ use.
10. Termination
We may suspend or terminate your account at any time for violation of these Terms, carrier rules, or law. Upon termination, your right to use the Service ends immediately. Sections 5 through 17 survive termination.
11. Disclaimers
The Service is provided “as is” and “as available.” We disclaim all warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that messages will be delivered without delay or error.
12. Limitation of Liability
To the maximum extent permitted by law, 24-7 Press and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or related to your use of the Service. Our total liability will not exceed the amount you paid to us in the three months preceding the claim.
13. Indemnification
You agree to defend, indemnify, and hold harmless 24-7 Press and its officers, employees, and affiliates from any claims arising from your use of the Service, including but not limited to violation of these Terms or applicable laws (such as TCPA or A2P 10DLC rules).
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to that jurisdiction.
15. Electronic Communications
By using the Service, you consent to receive electronic communications from us relating to your account and Service notices. These communications satisfy any legal requirement that such communications be in writing.
16. Modifications
We may modify these Terms at any time by posting a revised version on our website with an updated date. Material changes will be notified by email or dashboard alert. Your continued use after changes means you accept the new Terms.
