1 Acceptance of these Terms
These Terms of Service (“Terms”) govern access to and use of the websites, software, demonstrations, communications, and professional services operated or provided by 24-7 Press AI Solutions, LLC (“24-7 Press,” “we,” “us,” or “our”), including 24-7Press.com, TextBackAI, personalized AI voice demonstrations, AI voice agents, intake automation, call intelligence, and related services (collectively, the “Service”).
By accessing the Service, creating an account, submitting information, starting an AI voice demonstration, clicking an acceptance control, signing an order form, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you use the Service on behalf of a business or other organization, you represent that you have authority to bind that organization.
If you do not agree to these Terms, do not use the Service.
2 Eligibility
You must be at least 18 years old, or the age of legal majority where you live, and capable of entering into a binding agreement. You may not use the Service if applicable law, sanctions, carrier rules, platform rules, or a prior suspension prohibits you from doing so.
3 Description of the Service
The Service may include, depending on the applicable plan, project, or order:
- Personalized AI voice demonstrations created from submitted or public website information.
- Inbound and outbound AI voice agents, receptionists, intake systems, and follow-up workflows.
- Call recording, transcription, summarization, outcome classification, lead identification, and business-intelligence recommendations.
- Appointment scheduling, customer support, missed-call text back, email, SMS, CRM, and supported software integrations.
- Website development, SEO, local visibility, content, consulting, and implementation services.
- TextBackAI and other software products offered through 24-7 Press.
Features, integrations, limits, and availability may differ by client, location, carrier, plan, or third-party provider. A demonstration illustrates potential functionality and is not a promise that every demonstrated capability is included in a production deployment.
4 Artificial Intelligence Systems
The Service uses artificial intelligence, automated decision support, language models, speech technology, and third-party platforms. AI-generated responses, summaries, classifications, recommendations, and extracted website information may contain errors, omissions, outdated information, or unexpected output.
AI output is provided for operational support and general information. It is not legal, medical, financial, tax, emergency, or other professional advice. You are responsible for reviewing important output, testing workflows, approving production instructions, and maintaining appropriate human oversight.
Unless expressly agreed in writing, our systems do not independently make binding business decisions for you. Recommendations and call intelligence are intended to help authorized people make better decisions while remaining in control.
We do not guarantee any number of calls, leads, appointments, reservations, sales, customers, search rankings, cost savings, or revenue.
5 Voice Calls, Recording, and Transcription
When clearly disclosed on a demonstration or call interface, voice interactions may be recorded, transcribed, summarized, analyzed, and stored to provide the Service, improve approved agent behavior, troubleshoot issues, document outcomes, and generate call intelligence.
By clicking a button to begin a disclosed recorded demonstration or by continuing after a recording notice, you consent to that recording and processing. If you do not consent, do not begin or continue the interaction and contact us through another channel.
Clients deploying production voice systems are responsible for determining and implementing the notices, consents, retention rules, and restrictions required by the laws applicable to their callers, employees, customers, industries, and locations. Clients must not disable legally required disclosures.
The Service is not an emergency service and must not be used to place, receive, or manage 911 calls or other emergency communications.
6 Accounts and Security
Some parts of the Service are available without an account, including certain public pages and personalized demonstrations. Other services require an account or authorized access.
When an account is required, you must provide accurate information, protect your login credentials, restrict access to authorized users, and promptly notify us at support@24-7press.com of suspected unauthorized access. You are responsible for activity performed through your account unless prohibited by law.
7 Orders, Trials, Fees, and Billing
Fees, usage limits, included services, credits, implementation terms, and billing schedules are stated on the applicable checkout page, proposal, statement of work, subscription page, or order form. Those commercial terms are incorporated into these Terms. If there is a direct conflict, a signed order form or statement of work controls for that transaction.
We may offer trials, promotional credits, or limited demonstrations. Unless expressly stated otherwise, trials and promotional credits have no cash value, may be restricted, may expire, and may be changed or discontinued.
Recurring subscriptions renew automatically until canceled. You authorize us and our payment processor to charge the payment method on file for recurring fees, approved usage, taxes, and other charges described at purchase. You are responsible for keeping billing information current.
Unless an order form states otherwise, cancellation stops future renewal and access continues through the paid billing period. Fees already paid are non-refundable and are not prorated, except where required by law or expressly agreed in writing.
We may change pricing or plan features with reasonable notice. Continued use after a change takes effect constitutes acceptance of the updated commercial terms.
8 Client Responsibilities
Business clients are responsible for:
- Providing accurate, lawful, and authorized business information, instructions, content, contacts, and integration access.
- Reviewing and approving agent prompts, scripts, knowledge, disclosures, routing rules, and production behavior.
- Monitoring performance and promptly reporting inaccurate, unsafe, unauthorized, or noncompliant behavior.
- Obtaining and documenting required consent for calls, recordings, email, SMS, data processing, and customer communications.
- Maintaining required licenses, policies, registrations, disclosures, and carrier approvals.
- Ensuring that staff do not rely on AI output without appropriate review where an error could cause harm or legal exposure.
- Using only data and content the client has the right to submit, process, record, or communicate.
We may recommend changes, but the client remains responsible for final business rules, customer promises, pricing, reservations, legal compliance, and decisions made using the Service.
9 Email, SMS, and Other Communications
9.1 Service-related communications
When you request a demonstration, submit a form, schedule an appointment, create an account, or purchase a Service, we may send communications reasonably related to that request or relationship, such as demo links, appointment details, security notices, support responses, receipts, operational alerts, and other non-promotional messages.
9.2 Email marketing
We send marketing email only when we have an appropriate legal basis and, where required or promised, your affirmative permission. Marketing email will provide an unsubscribe method. Unsubscribing from marketing does not prevent necessary transactional or service-related messages.
9.3 SMS consent
SMS consent is optional and is not a condition of purchase. Where you affirmatively select an SMS consent option, you authorize 24-7 Press and its service providers to send messages to the phone number already associated with your request or account for the specific purpose described beside that option.
Consent to receive a demo link, appointment information, or another transactional text does not automatically authorize recurring marketing texts. Recurring automated marketing SMS requires a separate affirmative opt-in.
Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help. We may send one final confirmation after an opt-out request. After opting out, you must provide new consent before recurring messages resume.
We do not sell or share SMS opt-in consent with unaffiliated third parties for their own marketing. We may provide information to vendors that process communications for us, subject to our Privacy Policy and contractual restrictions.
9.4 Client messaging obligations
Clients using the Service to contact their own customers must comply with applicable laws, the Telephone Consumer Protection Act where applicable, CAN-SPAM, carrier rules, A2P 10DLC requirements, industry standards, do-not-call requirements, and the policies of telecommunications and messaging providers.
Clients must maintain evidence of consent, honor revocation and opt-out requests, accurately identify the sender, avoid deceptive content, and include required disclosures. The Service may automatically enforce certain opt-out controls, but that does not transfer the client’s compliance responsibility to us.
10 Acceptable Use
You may not use or assist others in using the Service to:
- Violate any law, regulation, court order, carrier policy, or third-party right.
- Send spam, unlawful robocalls, unlawful robotexts, or communications without required consent.
- Commit fraud, impersonate another person or business, misrepresent AI as a human where disclosure is required, or create deceptive content.
- Transmit illegal, threatening, abusive, discriminatory, exploitative, or malicious content.
- Send prohibited or restricted messaging content, including unlawful sexual content, hate content, illegal firearms activity, tobacco or vaping promotions directed to prohibited audiences, or other carrier-restricted content.
- Collect, upload, expose, or process data you are not authorized to use.
- Introduce malware, probe security, bypass limits, disrupt infrastructure, or interfere with another user.
- Reverse engineer, copy, scrape, resell, sublicense, or exploit the Service except as expressly authorized in writing.
- Use the Service for emergency response or high-risk decisions without qualified human review and written authorization.
We may investigate suspected misuse, limit traffic, remove content, suspend messaging, or terminate access when reasonably necessary to protect users, providers, carriers, the public, or the Service.
11 Data and Privacy
Our collection, use, disclosure, retention, and protection of personal information are described in our Privacy Policy.
Depending on how the Service is used, processed information may include contact details, business information, website content, consent selections, timestamps, device or network information, call audio, transcripts, summaries, outcomes, appointments, messages, and integration data.
You retain ownership of content and data you lawfully provide. You grant us and our authorized processors a limited right to host, copy, transmit, transform, analyze, and otherwise process that material as necessary to provide, secure, support, and improve the Service, comply with law, and enforce these Terms.
When you submit a website for a personalized demonstration, you authorize us to access and process publicly available content from that website for the requested demonstration. You represent that you are authorized to request the demonstration for the submitted business.
12 Third-Party Services and Integrations
The Service relies on third-party providers for telecommunications, artificial intelligence, hosting, databases, payments, email, SMS, scheduling, analytics, and integrations. These may include providers such as Twilio, Vapi, Supabase, Stripe, Mailchimp, Google, and other vendors.
Third-party services are governed by their own terms and policies. We are not responsible for outages, changes, restrictions, data loss, delivery failures, pricing changes, or acts of third-party providers beyond our reasonable control. We may replace, add, or discontinue providers or integrations.
13 Intellectual Property
The Service, software, systems, workflows, designs, interfaces, documentation, prompts, templates, branding, graphics, and other materials provided by 24-7 Press are owned by us or our licensors and are protected by intellectual-property laws.
Subject to payment and compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the applicable Service for your internal business purposes during the authorized term. No ownership rights are transferred unless a signed agreement expressly states otherwise.
If you provide feedback, suggestions, or ideas, you grant us a perpetual, worldwide, royalty-free right to use them without obligation or attribution, provided we do not publicly identify you without permission.
14 Confidentiality
Each party may receive nonpublic information that a reasonable person would understand to be confidential. The receiving party will use reasonable care to protect that information and will use it only to perform or receive the Service.
Confidential information does not include information that was already lawfully known, becomes public without breach, is independently developed without use of the other party’s information, or is lawfully received from another source. Disclosure may be made when required by law after reasonable notice where legally permitted.
15 Service Availability, Changes, and Support
We work to provide reliable Service, but telecommunications networks, browsers, microphones, carriers, artificial-intelligence providers, websites, integrations, and other dependencies can fail or behave unexpectedly. We do not guarantee uninterrupted, timely, secure, or error-free operation.
We may modify, replace, limit, suspend, or discontinue features. Support levels and response targets are those stated in the applicable plan or written agreement. Maintenance, security events, provider outages, abuse prevention, or legal requirements may affect availability.
16 Suspension and Termination
You may stop using the Service at any time and may cancel recurring subscriptions as provided in the applicable account, order form, or cancellation instructions.
We may suspend, restrict, or terminate access if you violate these Terms, fail to pay amounts due, create legal or security risk, generate excessive complaints, violate carrier or provider rules, misuse the Service, or if continued performance becomes unlawful or commercially impracticable.
Upon termination, your right to use the affected Service ends. Payment obligations and provisions that by their nature should survive—including ownership, confidentiality, disclaimers, liability limits, indemnification, and dispute terms—will survive.
17 Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” 24-7 PRESS DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT AI OUTPUT, WEBSITE INFORMATION, CALL SUMMARIES, TRANSCRIPTS, CLASSIFICATIONS, RECOMMENDATIONS, MESSAGES, APPOINTMENTS, RESERVATIONS, OR INTEGRATIONS WILL BE COMPLETE, ACCURATE, DELIVERED, AVAILABLE, OR ERROR-FREE.
Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
18 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 24-7 PRESS AND ITS OWNERS, AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, BUSINESS, GOODWILL, OR DATA; FAILED OR MISROUTED COMMUNICATIONS; MISSED LEADS, BOOKINGS, OR RESERVATIONS; OR THE COST OF SUBSTITUTE SERVICES, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO 24-7 PRESS FOR THE AFFECTED SERVICE DURING THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose. Some jurisdictions do not permit certain limitations, so portions of this section may not apply.
19 Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless 24-7 Press and its owners, affiliates, officers, employees, contractors, licensors, and providers from claims, damages, losses, liabilities, penalties, settlements, costs, and reasonable attorneys’ fees arising from or related to:
- Your content, data, instructions, contacts, campaigns, calls, recordings, or messages.
- Your use or misuse of the Service.
- Your violation of these Terms, law, carrier rules, or third-party rights.
- Your failure to obtain required consent or provide required disclosures.
- Products, services, promises, pricing, reservations, or decisions offered or made by your business.
We may control the defense of an indemnified matter, and you agree to reasonably cooperate. You may not settle a claim that imposes liability or an admission on us without our written consent.
20 Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising from or related to these Terms or the Service will be brought exclusively in the state or federal courts located in Travis County, Texas, and each party consents to personal jurisdiction and venue there.
Before filing a claim, each party agrees to provide written notice describing the dispute and to make a good-faith effort for at least 30 days to resolve it informally, unless immediate relief is necessary to prevent irreparable harm or preserve legal rights.
21 Electronic Communications and Changes
You consent to receive electronic records, notices, disclosures, and service communications. Electronic communications satisfy legal writing requirements to the extent permitted by law.
We may revise these Terms by posting an updated version with a new effective date. Where required or commercially reasonable, we will provide additional notice of material changes. These Terms, the Privacy Policy, applicable order forms, statements of work, and incorporated policies constitute the entire agreement regarding the Service and replace prior discussions on the same subject.
